PUBLIC OFFER Of the Online Store "Wamiles Europe"

The following text is a public offer to an indefinite number of persons regarding the purchase and sale of goods offered on the website of the online store at: https://wamiles-europe.com (hereinafter referred to as the Online Store), for the purpose of concluding a public contract with the user of the Online Store services (hereinafter referred to as the Buyer), in accordance with Articles 633, 641, 642 of the Civil Code of Ukraine.

  1. DEFINITION OF TERMS 1.1 Public Offer (hereinafter referred to as the Offer) – a public proposal by the Seller addressed to an indefinite number of persons to enter into a contract of sale of goods remotely (hereinafter referred to as the Agreement) under the terms specified in this Offer. 1.2 Website of the Online Store (hereinafter referred to as the Website) – a website located at https://wamiles-europe.com, which represents a set of pages and software modules, where information about goods, purchase and sale terms, delivery, and other conditions that have the characteristics of an offer, as well as the possibility of ordering goods and processing such an order, is presented. 1.3 Goods – the list of goods published on the Website of the Online Store. 1.4 Website User – a visitor to the site https://wamiles-europe.com. 1.5 Buyer – a user of the site, a natural person who places an order and buys goods presented in the Online Store. 1.6 Seller – Individual Entrepreneur Vinnytska V.A., code - 3827910600 1.7 Order – an order placed by the Buyer through filling in personal data required for order processing and information about the goods in the appropriate section of the Website or by sending this information to the Seller by phone or email, as indicated on the Website. 1.8 Buying Goods via the Online Store – placing an order and paying for goods by the Buyer based on the description of the goods presented on the Website, excluding the direct physical examination of the goods during the conclusion of the purchase and sale agreement.

  2. GENERAL PROVISIONS 2.1 Acceptance of the Offer (acceptance) is the placement of an order by the user on the Website of the Online Store, by phone, or by sending a message to the Seller's email. 2.2 The Website Administration has the right to make changes to the Offer without notifying the Buyer. 2.3 The User independently places an order for goods based on their free choice from the assortment presented on the Website of the Online Store. 2.4 The procedure for purchasing goods on the Website of the Online Store includes:

  • Independent familiarization of the Buyer with the assortment of goods in the catalogs and the terms of sale, payment, and delivery presented on the Website;
  • The Buyer’s choice of goods at their discretion and according to their needs, and the placement of an order for the goods through the appropriate form on the Website, by phone, or email, as indicated on the Website;
  • Payment by the Buyer for the goods by one of the methods available for selection on the Website of the Online Store;
  • Processing, delivery, and transfer of the goods to the Buyer. 2.5 The term of validity of the Offer is unlimited unless otherwise stated on the Website.

  1. SUBJECT OF THE OFFER 3.1 The terms of the public offer (offer) are the provision of services by the Online Store to the potential Buyer, which consists of presenting a choice of goods, accepting and processing the order for the purchase and delivery of the selected Goods. 3.2 The Buyer accepts the terms of this offer at the moment of placing the Order by clicking the "Place Order" button or placing an order by phone or by sending a message via email. This action expresses the Buyer’s intent to purchase the selected Goods and indicates that they are familiar with the description of the Goods, its price, the terms of payment and delivery of the Goods, the procedure and conditions of exchange and return of Goods, and other essential terms of the purchase and sale agreement. 3.3 From the moment the Buyer accepts this Offer by clicking the "Place Order" button or placing an order by phone or sending a message by email, it is considered that the Buyer and the Seller have agreed on the conclusion of an electronic contract, under which the Seller undertakes to transfer the selected goods to the Buyer’s ownership, and the Buyer undertakes to accept and pay for the Goods.

  2. PRICE OF THE GOODS 4.1 The price for each unit of goods is indicated on the Website. 4.2 The Seller has the right to unilaterally change the price for any item of Goods. 4.3 The Buyer has the right to confirm or cancel the order if the price has changed after the order has been placed. 4.4 The Seller indicates the estimated delivery cost of the Goods on the Website, in particular, in the section “Shipping and Payment Policy”. The exact delivery cost is calculated by the courier service operator based on the weight of the ordered Goods and the delivery distance. 4.5 The Buyer’s payment obligations are considered fulfilled when the funds are credited to the Seller’s account. 4.6 Payments between the Buyer and the Seller are made by the methods and in the order specified on the Website in the “Delivery and Payment Policy” section.

  3. ORDERING GOODS 5.1 The Buyer places an order for the Goods through the Operator by phone at the numbers indicated on the Website or through the Online Store service at https://wamiles-europe.com by clicking the "Place Order" button or by sending an email to wamiles.europe@gmail.com. 5.2 When placing an Order, the Buyer undertakes to provide the necessary information for executing the Order regarding the Goods: name, quantity, and personal details: full name, contact details, delivery address, selected delivery method, selected payment method. 5.3 If necessary, the Seller has the right to request additional information from the Buyer needed to process the Order. In case the Buyer does not provide the required information, the Seller is not responsible for the improper fulfillment of the Order due to the lack of such information. 5.4 The Seller processes the Order during business hours in the order and within the time frame specified on the Website:

  • when ordering through the Website service – in the “Delivery and Payment Policy” section – “Order Processing through the Cart”;
  • when ordering through the Operator by phone or email – in the “CONTACTS” section. 5.5 The Buyer’s acceptance of the terms of this Offer is made by placing an Order through the electronic form on the Website, sending a message about the Order to the email, or through the Operator by phone. After placing the Order, the Buyer’s details are registered in the Seller’s database. 5.6 The Seller is not responsible for the content and accuracy of the information provided by the Buyer when placing the Order. 5.7 The Buyer is responsible for the accuracy of the information provided to the Seller when placing the Order. 5.8 The purchase agreement between the Seller and the Buyer is considered concluded remotely from the moment the funds paid by the Buyer for the Goods are credited to the Seller’s account.

  1. DELIVERY 6.1 The Seller ensures the delivery of the Goods to the Buyer by one of the methods specified in the "Delivery and Payment Policy" section on the Website via the corresponding delivery service. Reference information on delivery can be obtained at the link: https://wamiles-europe.com/uk/pages/shipping-payment-policy. 6.2 The Website indicates the approximate delivery cost; the exact cost and delivery time are provided by the delivery service, depending on the delivery distance and the weight of the purchased Goods. 6.3 The Buyer independently specifies the delivery address when placing the Order. 6.4 The delivery time consists of the order processing time and the delivery time of the Goods. 6.5 Upon delivery of the Order, the Buyer receives a document confirming payment for the Goods.

  2. RETURNS AND EXCHANGES 7.1 The exchange and/or return of Goods is carried out in accordance with the requirements of the Law of Ukraine "On Consumer Protection." 7.2 General terms for the return and exchange of Goods are posted on the Website in the “Delivery and Payment Policy” section – “Return and Refund Policy” and available at the link: https://wamiles-europe.com/uk/pages/shipping-payment-policy, where you can familiarize yourself with:

  • The terms of return of Goods;
  • The period within which the return of Goods is possible;
  • The procedure for the exchange and return of Goods;
  • The procedure for returning funds.

  1. PROCESSING PERSONAL DATA 8.1 When placing an Order, the Buyer provides their personal data and consents to its processing and use, in accordance with the Law of Ukraine "On the Protection of Personal Data." 8.2 The Seller uses the personal data provided by the Buyer for the purpose of selling and promoting the Goods and services of the Online Store, sending informational messages to the Buyer regarding the offers of the Online Store. 8.3 The Seller undertakes not to disclose the Buyer’s personal data. Disclosure of personal data to third parties for the purpose of fulfilling the Order is not considered disclosure, as well as in cases where such information disclosure is necessary due to the requirements of current legislation.

  2. INTELLECTUAL PROPERTY 9.1 The Website features images of registered trademarks, brand names, and product designs, etc., which are protected under applicable law and international agreements. 9.2 All rights to the content of the Website belong to the Seller and are protected by Ukrainian law. 9.3 Using materials posted on the Website without the Seller's permission is unlawful.
